2820 Trustee Sale
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated January 31, 2011, and the Deed of Trust of even date securing the same, recorded February 3, 2011, in Book No. RB293, at Page 581, in Office of the Register of Deeds for White County, Tennessee, executed by James R. Brown and Amanda Brown, conveying certain property therein described to Andrew C Rambo as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for First Community Mortgage, Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Lakeview Loan Servicing, LLC.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Lakeview Loan Servicing, LLC, will, on November 2, 2017 on or about 11:00 AM, at the White County Courthouse, Sparta, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. 2810 Substitute Trustee Sale
FORECLOSURE AND SUBSTITUTE
Default having been made in the terms and conditions of payments, pursuant to a certain Deed of Trust executed by Kevin P. Duggan, Leo G Duggan and Sylvia P. Duggan, to Arnold M. Weiss of Shelby County, TN, Trustee, for MERS as nominee for Guaranty Mortgage Services, LLC, dated the 31st day of August, 2010 and being of record in Book 287, page 454, Register’s Office for White County, Tennessee, referred to herein as the deed of trust, which conveyed certain real property, appurtenances, estate, title and interest therein in trust to secure the indebtedness described therein, which indebtedness is now due and unpaid and has been declared in default by the lawful owner thereof, Guaranty Bank a division of First-Citizens Bank & Trust Company. Appointment of Substitute Trustee having been duly executed by the holder of the note and beneficiary of said Deed of Trust, and appointing William Timothy Hill as Substitute Trustee.

This conveyance is made subject to all matters shown on plat recorded in Plat Book 1, page 353, and Restrictions record in Record Book 117, page 865, in the Register’s Office for White County, TN.
BEING the same property conveyed to Kevin P. Duggan, Leo G. Duggan and Sylvia P. Duggan by Joint Tenancy Deed dated 8/31/10 of record at Book 287, page 452, in the Register of Deeds Office for White County, Tennessee.
This is improved property known as 2560 Wildcat Road, Sparta, TN 38583.
If there is any discrepancy with the street address, the legal description will control.
The sale of the property described in said Deed of Trust shall be subject to any and all instrument of record, prior liens, encumbrances, deeds of trust, easements, restrictions, building lines, unpaid taxes, assessments, penalties and interest, if any. All right and equity of redemption, homestead, dower and all other exceptions are expressly waived in said Deed of Trust, and the title is believed to be good, but the Substitute Trustee will convey and sell only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day or time certain without further publication, upon announcement at the time for the above. This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded at any time.
