NOTICE OF SUBSTITUTE TRUSTEE SALE
Default having been made in the terms, conditions, and payments provided in a certain Deed of Trust dated June 15, 2000, executed by Robert Cloyd and Lisa Cloyd, husband and wife, to Marsha Fogle as Trustee for the benefit of Associates Home Equity Loan Corporation, of record in Book RB101, Page 398, in the Register’s Office for White County, Tennessee, conveying certain real property therein described, and Edward D. Russell of The SR Law Group, having been appointed as Substitute Trustee of record in Book RB467, Page 541, Register's Office for White County, Tennessee;
WHEREAS, the said Deed of Trust was last assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, AS TRUSTEE OF THE BUGALOW SERIES III TRUST (“Holder”), by SN Servicing Corporation, its attorney in fact, the entire indebtedness having been declared due and payable and Holder having requested foreclosure proceedings to be instituted; and as provided in said Deed of Trust, Edward D. NOTICE OF SUBSTITUTE TRUSTEE’S SALE
WHEREAS, on December 18, 2015, DONNA GIBSON, executed a Deed of Trust to Walter G. Birdwell, Jr., Trustee for Citizens Bank of Carthage, for a certain indebtedness, which Deed of Trust was recorded in RB372, Page 456 in the Register’s Office for White County, Tennessee; and
WHEREAS, default having been made in the payment of the indebtedness, I, WLLIAM D. MITCHELL, Substitute Trustee, by virtue of instrument recorded in the Register’s Office for White County, Tennessee, will sell the property on Friday, January 8, 2021 at 1:00 o’clock p.m. CDST, at the East Door of the White County Courthouse, Sparta, Tennessee to the highest and best bidder, for cash, as described in the Deed of Trust as follows:
Lying and being in the Fourth (4th) Civil District of White County, Tennessee and more particularly described as follow, to-wit:
Being Lot No. 9 of the Brook Hill Subdivision, as shown by plat of record in Plat Book 1, Page 20 in the Register’s Office for White County, Tennessee, to which reference is made for a more perfect description.
The previous and last conveyance being a Warranty Deed from James D. Oakes to Donna L. Gibson as found recorded in WDB 193, Page 113, in the Register’s Office for White County, Tennessee.
Restrictive covenants of record in Miscellaneous Book No. 36, Page 623 in the Register’s Office for White County, Tennessee.
A ½ interest in mineral rights has been reserved in two instruments of record in Miscellaneous Book No. 8, Page 455 and Miscellaneous Book No. 9 Page 482 in the Register’s Office for White County, Tennessee.
Reference is further made to County Property Tax Map 023P, Group A, Parcel 008.00 in the Tax Assessor’s Office for White County, Tennessee and said property is located at 272 Brookhill Drive, Sparta, TN 38583.
Said sale will be bar of equity and right of redemption, homestead, dower and all other exemptions. The sale will also be made subject to the payment of all unpaid taxes. The proceeds derived from said sale will be applied to the payment of the costs and charges of the sale and the indebtedness set forth in the Deed of Trust.
The sale held pursuant to this Notice may be rescinded by the Substitute Trustee or adjourned the day of sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
