NOTICE OF SUBSTITUTE TRUSTEE’S SALE

 

WHEREAS, on May 28, 2014, LANNY WHEELER and wife, JESSICA WHEELER, executed a Deed of Trust to KRISTIN SPARKS, Trustee for DAVID CLOUSE, for a certain indebtedness, which Deed of Trust was recorded on May 28, 2014, in RB347, Page 645, in the Register’s Office for

 

White County,

Tennessee; and

WHEREAS, the afore

described Deed of Trust was subsequently assigned to MTFN, Inc. as found

recorded in RB347, Page 648, in the Register’s Office for White County, Tennessee; and

 WHEREAS, default having been made in the

 payment of the

indebtedness, I, WILLIAM D.

MITCHELL, Substitute

Trustee, by virtue of

 instrument recorded in RB 456, Page 390, in the Regis-ter’s Office for White County, Tennessee, will sell the property on Friday, November 4, 2022 at 1:00 o’clock p.m. Central Time, at the East Door of the White County Courthouse, Sparta, Tennessee to the highest and best bidder, for cash, as described in the Deed of Trust as follows:

 

 Lying and being in the Third (3rd) Civil District of White County, Tennessee and more particularly described as

 follow, to-wit:

Land in White County, Tennessee, Being all of Lots Nos. 30 and 31 on the plan of Disneyland Subdivision, of record in Plat Book 1, Page 54 & 55, said Register’s Office, reference to which is hereby made for a more complete description.

 

The afore described property is subject to the restrictive covenants as found in Miscellaneous Book 27, Page 157, in the Register’s Office for White County, Tennessee.

 

This conveyance is made

subject to the easement, if any, held across certain minor portions of the herein

 

conveyed property by Caney Fork Electric Corporation, Inc., for the purposes of installation and maintenance of power facilities for this and the other lots in said subdivision.  The plat appears of record in Plat Book No. 1, Page 54, in the Register’s Office for White County, Tennessee, and the Right of Way Easement appears of record in Miscellaneous Book No. 27, Page 155, in the Register’s Office for White County, Tennessee.

 

The previous and last

conveyance being a

 Warranty Deed to Lanny Wheeler and wife, Jessica Wheeler, as found recorded in RB 347, Page 643, in the Register’s Office for White County, Tennessee.

 

Reference is further made to County Property Tax Map 080H, Group E, Parcels 014.00 (Lot 30) 001.01

(Lot 31) and  in the office of the Assessor of Property for White County, Tennessee and said property is located at 171 Aqua Way, Sparta,

TN   38583.

 

 Said sale will be bar of

equity and right of

redemption, homestead, dower and all other

ex-emptions.  The sale will also be made subject to the payment of all unpaid taxes.  The proceeds derived from said sale will be applied to the payment of the costs and charges of the sale and the indebtedness set forth in the Deed of Trust.

 

 The sale held pursuant to this Notice may be rescinded by the Substitute Trustee or adjourned the day of sale to another day, time, and place certain without further publication, upon

announcement at the time and place for the sale set forth above.
