NONDISCRIMINATION POLICY

Title VI of the Civil Rights Act of 1964, of the Education

Amendments of 1972 and Section 504 of the

Rehabilitation Act of 1973 require school districts to have officially adopted policy statements of

nondiscrimination on the basis of sex,

disability, national origin and race.

“It is the policy of the Van Buren County School System not to discriminate on the basis of sex, race,

national origin, creed, age, marital status, or disability in its

educational program, activities or

employment

policies as required by Title VI and VII of the 1964 Civil Rights Act, Title IX of the 1972 Educational

Amendments and

Section 504 of the Federal Rehabilitation Act of 1973.

It is also the policy of this district that the curriculum

materials utilized reflect the cultural and racial

diversity present in the United States and the variety of careers, roles and lifestyles open to women as well

as men in our society. One of the objectives of the total curriculum and teaching strategies is to reduce

stereotyping and to eliminate bias on the basis of sex, race, ethnicity, religion, and disability. The

curriculum should foster respect and appreciation for the cultural diversity found in our country and an

awareness of the rights, duties, and responsibilities of a pluralistic society.”

Inquiries

regarding compliance with Title VI, Title IX and Section 504 may be directed to the Special

Education Director, P.O. Box 98, Spencer, Tennessee 38585, (931) 946-2242.

followed, the matter may be referred to the board, which will give

the complaint prompt attention.

NOTICE TO  PATRONS

The schools collect and maintain student records to provide for the growth and

development of

individual students, to

provide information to parents and authorized staff, and to provide a basis for the evaluation and improvement of

school programs.

Section 438 of the General Education Provisions Act, as amended, sets out

requirements designed to

protect the privacy of parents and students. Specifically, the statute governs disclosure of records maintained by

educational

institutions, which receive federal funds.

In brief, the statute

provides that such

institutions must

provide parents of

students access to

official records directly

related to the students and an opportunity for a hearing to challenge such records on the grounds that they are

inaccurate, misleading or otherwise

inappropriate; that institutions must obtain the written consent of parents before

releasing personally identifiable data about students from records to other than a

specified list of

exceptions; that

parents and students must be notified of these rights transfer to students at certain points; and that an

office and review

board must be

established. This office is the Family Policy Compliance Office of the U.S. Department of Education.

They will investigate and adjudicate

violations and

complaints of this

section.

A copy of the policy and administrative regulations adopted by the Board of Education in compliance with Section 438

of the General

Education Provisions Act may be obtained.

INFORMATION WHICH IS MAINTAINED

The school system maintains a number of different records in various locations.

Essentially, these records contain

twelve (10) categories of information:

  1. Attendance 7.

Discipline

  1. Academic record 8. Emergency contact information
  2. School programs 9. Biographical data
  3. Group test results 10. Directory

information

  1. Individual

assessment data

  1. Special testing results

The school system may release the following directory information without prior notice to a parent: student’s name,

address, telephone listing, date and place of birth, program of study, participation in officially recognized activities

such as sports, weight and height of members

of athletic teams, dates of attendance, degrees and awards received, the

most recent previous school attended by the student. A parent/legal guardian or eligible student who does not want

directory information to be released without prior consent should so notify, in writing, the local school principal within

twenty days from date of annual notification.

LOCATIONS AND AUTHORIZED CUSTODIANS

The primary source of access to most records is the elementary, secondary, or special school in which a student is

enrolled. The principal is the authorized

custodian for these

records. Records

pertaining to the

disciplinary hearings

and suspensions are maintained in the office where the proceedings occurred.

The Special Education Department maintains records for children in the Special Education Programs, and these records

are regulated by the Director of Special Education. If a student moves, the student record will be sent to the new school

upon transfer record

request from the school.
